3. Counter-Notification

If you believe that your content was removed by mistake or misidentification, you may file a counter-notification. To be effective, the counter-notification must be a written communication that includes the following:

  • Your physical or electronic signature.

  • Identification of the material that has been removed and the location where it appeared before removal.

  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.

  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, KeloNews has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or contributors who are deemed to be repeat infringers.

5. Fair Use Disclaimer

As a news and fact-checking organization, KeloNews often makes use of copyrighted material for purposes such as criticism, comment, news reporting, teaching, scholarship, or research. This is known as “Fair Use” under Section 107 of the U.S. Copyright Act.
